Quadrant Economics at Washington Arbitration Week 2025

Quadrant Economics is proud to share that our Managing Director, Daniel Flores, participated as a panelist during the sixth edition of Washington Arbitration Week, held in Washington, D.C., from October 6 to 10, 2025.
Dr. Flores joined an esteemed panel alongside Garrett Rush (Secretariat), Sencer Ecer (Compass Lexecon), Sirshar Qureshi (CIS Dispute), and Dr. Borzu Sabahi (Curtis, Mallet-Prevost, Colt & Mosle). The session, titled “Sunk Cost Analysis as a Basis for Quantum Awards on Quantum in International Arbitration,” explored the evolving role of sunk cost analysis. The panel addressed whether yesterday’s spending can justify today’s compensation, and discussed whether sunk cost is being overused or whether its application is in decline.
The discussion also examined the circumstances in which tribunals favor sunk cost approaches over forward-looking methods in an effort to construct non-speculative but-for scenarios. Panelists compared how the method performs against other valuation techniques and considered when its application is most appropriate, given the specific features of each case.
